Terms of use
The rules for using Oryva, a player that provides no content.
This English translation is provided for convenience. The French version (Conditions générales d’utilisation) is the one accepted and recorded, and it prevails.
1. Purpose
These terms of use (the “Terms”) govern the use of the Oryva app for Android and Android TV, of the oryva.org website and of the related services (together, the “Service”), published by MGCORP (the “Publisher”).
Creating an account or using the Service means fully accepting the Terms. The acceptance is recorded with its date, the version of the text and the technical information needed to prove it.
2. What Oryva is
Oryva is a media player. It plays sources that users add themselves: playlists (M3U), Xtream Codes accounts, Stalker portals or files.
Oryva does not provide, sell, host, broadcast, list or recommend any channel, programme, film or series. The Publisher has no link with the providers of the sources added by users and has no knowledge of their content.
Video streams go directly from the user’s source to their device; they never pass through the Publisher’s servers.
3. The user’s responsibility for their sources
The user warrants that they hold all the rights and authorisations needed to access the sources they add and to watch their content, in particular with regard to copyright and related rights. They confirm it each time they add a source; this confirmation is recorded.
It is forbidden to use the Service to access infringing content, to circumvent a technical protection measure, to share access credentials to a source with unauthorised third parties, or in any other way contrary to the law or to the rights of others.
The user is solely responsible for the sources they add, their content and the use they make of them. They indemnify the Publisher against any claim, action or judgment resulting from a breach of these commitments, including reasonable defence costs.
Upon a report of unlawful use or at the request of an authority, the Publisher may suspend or close the account concerned, under the conditions of article 9.
4. Account
An account is needed to use the app. It is created with a verified email address and a password, or with a Google account. The user must be at least 15 years old, or have the consent of a holder of parental authority.
The user keeps their credentials confidential and informs the Publisher of any unauthorised use. The number of devices connected at the same time depends on the plan (2 on Free, 5 on Premium).
5. Plans
The Free plan includes one source, live TV, the TV guide, reminders and 5 favourites. The paid Premium plan is governed by the terms of sale. The details of the plans are given in the app and on oryva.org.
6. Sync and encryption
With Premium, sources, favourites, profiles and playback positions can be synced between the user’s devices. Source configurations are end-to-end encrypted: the Publisher cannot read them. The user remains responsible for keeping their data on their devices.
7. Intellectual property
The app, the website, the Oryva brand, the logos and all their components belong to the Publisher. The user is granted a personal, non-exclusive and non-transferable right of use for the life of their account. Any reproduction, decompilation or modification is forbidden except where the law allows it.
8. Availability and liability
The Publisher strives to keep the Service available but does not guarantee uninterrupted availability; maintenance may suspend it temporarily.
The Publisher is not responsible for the availability, quality, lawfulness or content of the sources added by the user, nor for the relationship between the user and the provider of those sources.
To the extent permitted by law, the Publisher’s liability is limited to direct and foreseeable damage. Nothing in the Terms limits the rights a consumer holds under mandatory legal provisions.
9. Suspension and termination
The user may delete their account at any time from the app (My account).
In the event of a serious breach of the Terms, in particular of article 3, the Publisher may suspend or terminate the account after informing the user, except in an emergency or where the law requires otherwise; the user may submit their observations to [email protected].
10. Personal data
The processing of personal data is described in the privacy policy, available in the app and on oryva.org/en/privacy.
11. Changes to the Terms
The Publisher may change the Terms. The new version is presented in the app and must be accepted to keep using the Service; otherwise, the user may delete their account.
12. Governing law and disputes
The Terms are governed by French law. In the event of a complaint, the user first writes to [email protected]; the Publisher undertakes to answer within 30 days and to seek an amicable solution.
Failing an amicable solution, the dispute is brought before the competent courts under the ordinary rules.
